Traffic laws in Spain - information

When driving it is importent to know the laws and this is even more importent when you are driving abroad. Rules that you take for granted at home may be treated different here in Spain. Who is responsible

The driver of a motorcycle - if the passenger is not wearing a helmet.
The driver - if child restraint is not used as required by law.
The father - is responsible to pay fines for a under age driver.
The driver who is registred as the standard driver of a vahicle, if it is not possible to identify the driver.
For leased or rented vehicles: the tenant if it is not proved that the vehicle was driven by another driver.

If you get a fine

Reduced If the fine is paid in 20 calendar days and there are no arguments:
• 50% discount on the fine.
• You can not make claims and completes the procedure.
• The penalty does not count as a precedent, unless it has loss of points.

Regular Served with the complaint, there may be arguments, but no discounts.
• If there has been no stopping of the vehicle, the driver must be identified in 15 days.
• If there is no arguments or the fine is paid, the fine become final in 30 days and executed.

Updates of violations

To park a vehicle in a designated parking spot is now concidered as severe and also manipulation of the parking meter.
It is obligated that the registration of the vehicle is readable. Any manipulations to hide the vehicle registration will be fined.
The owner of the vehicle is responsible that anyone who drives the vehicle has the right permits for driving the vehicle.
It is allowed to park bicycles and mopeds on sidewalks.
The use of radar detectors or inhabitors is under fine of 6.000 € (those who install such equipment up to 20.000 €).

Fixed amounts on fines

Minor offences: 100 €
Other: 200 €
Very serious offences: 500 €

In any infringement will be applied.
Temporary suspension of permit and repealing the inability to obtain the permit in two years for driving without obtaining same.

How do you get notified about fines.

For residents Spain has introduced the possibility to be notified electronicly but also
by post within two weeks.

When you rent a car from BookRentACarInSpain.com the police will notify us about fines. We are obligated by law to identify the tenant of the rental lease to the police. We will contact you in the event we get notified about a fine on the vehicle you rented.

What to do if you are not in agreement

If you have chosen to make submissions to a complaint can override the resolution sanctioning the sanction or with sign and, where appropriate, we will proceed to the withdrawal of the points.

Deduction of 4 points:
Driving under influence of alcohol: Between than 0,25 and 0,50mg/l alcohol in exhaled air (0,15-0,30 mg/l for professionals and beginners).
Driving a vehicle with a inappropriate permission.
Throwing objects on the road and its surroundings that can cause fires, accidents or hinder.
Skipping a stop sign, a traffic light or does not respect the right of way to go etc.
Endanger cyclists when overtaking or hindering the same.
Driving in reverse on highways.
Failure to maintain the safety distance with the vehicle ahead.
Failure to observe signals of circulation from agents (police, road workers etc).

Deduction of 3 points:
Use of navigators, mobile phones etc. that reduce attention.
Failure to use seat belts, child safty restraints, helmets or other protective devices.

SPEED. The dermetation points deduction will depend on the excess speed. See table above.

Violations that are not subject of points deductions.

Negliant driving.
Stopping or parking in the lanes for urban public transport.
Driving without lights or to misuse the same.
Having a passenger who is less then 12 years old on motorcycles or mopeds.
Stopping or parking in curves, dips, tunnels, underpasses or intersections.
Driving with an excess of 50% or more of the authorized number of seats.
